Pivot Forced To Change Name

Sydney’s Pivot have changed their name to PVT, but it has absolutely nothing to do with them embracing New York art rock and donning paisley shirts.

Echoing The Ooga Boogas tussle with a Melbourne design firm, the band were recently issued with a cease and desist letter from a woefully shit US nu-metal act using the same name (direct hate mail here). The letter claimed that Pivot (the Australian/good one) were infringing upon a registered US trademark that had recently been acquired. The band have decided not to fight the action.

“All things considered, the potential legal expense of fighting this was far too great and really not worth the risk for us,” read a statement on the band’s MySpace page. “So we had to lose a few vowels to keep doing what we do, and chose to do it worldwide for the sake of keeping things concise. At the end of the day it’s small change, and we hope you’ll adjust to as quickly as we have.”

In better news, the band formerly known as Pivot will release their third album, Church With No Magic, on Warp Records on July 19 (see its genesis here). They’ve also announced a bunch of launch dates in August. Dates below.

Pivot is a group in relentless pursuit of perfection and constant change. Its members share more than just a passion for their work. They have a sense of urgency in re-inventing themselves with every word put to paper or note put to tape. Their live show incorporates simplistic visual effects that tie sight and sound into one. Pivot will leave its audience making plans to see the next show. This band is quite simply interested in one thing...creating good music.

This happens alot in the racing industry when horse come over from NZ to race in Australia and the name is already taken. Usually the just put a Lord or a Sir in front of the existing name.

Is this something the US ''band'' is doing in the hope there is some financial benefit for them (i.e. Aust Pivot needs to buy the trademark)?

Does this mean their previously released records - if reissued need to have a name change?

Wikipedia reckons nu-metal were around since 96, and Australian since 99.

Australian pivot don't have a prior use claim to fight the Trade Mark with, so I don't see that they'd have any hope of releasing in US market with the same name.

I think PVT did the right thing by changing their name considering that the American Pivot has an impressive 56,672 views on Myspace and are unsigned, unknown, broke and crap.
They would prove a formidable foe in the international courts with their non existent financial might and would crush PVT if they could. But they can't. Same way as pigs can't fly.
They would need a case to begin with. Two little bands with no money and the same names isn't actually something the Legal Universe is interested in even though bands and music industry types would like to think that they are Very Important People. There are millions of bands with the same name and they don't exactly set the Legal Universe on fire.
Because they are insignificant.

I think it's Americas shitty 'first use in a territory' problem. If someone's used a name before in the US, then it's theirs. Sure, Pivot could fight and win, which could and would take loads of time but if they didn't win, they'd be screwed for the time AND up for a shitload of money

pivot probably got targeted because they are now on warp records and potentially would be worth suing. and yeah, they probably did the right thing, and there's a lot of precedent for just ditching the name (mantioba -> caribou comes to mind). you have to sell a lot of records to pay for a team of defence lawyer-ninjas.

That's not shitty, it's good. Also it's in Australia.

It's good because it protects people who can't afford a Trade Mark.

Let's say little-business-man has been using the name little-business-man for a few years, then some cunt starts a new business called little-business-name to steal their customers, and buys a Trade Mark.

LBM#2 sayd to LBM#1 well I've got the Trade Mark, so you can't use the name any more.

LBM1 can say well Fuck You actually just because you paid for a Trade Mark, doesn't matter because I was using the name first.

LBM2 actually has to stop using the name even though they purchased a Trade Mark.

The lesson here for everyone starting a band is that if you think you're going to get big enough to sell any music, do a fucking google search first to find out if anyone else has your name.

If they don't, publish some pages on the web in as many places as possible saying your a band using that name. That will give you some proof to having a prior use claim if anyone starts using your name later.

I know I will probably get a ferocious thrashing for saying this, but I checked out the US Pivot band and they aren't half bad. It wasn't at all what I expected. I do however agree that this whole name business is crap! I used to be in a band and quit because of all of the business bullshit. It was just draining. Bands should just get unique numbers assigned to them so we don't have to dwell on such petty words. It's a shame when it comes to that. How can anyone really own a goddam word???
