Dear Friends of The Birmingham

We'd like to reach out for your help!

Since new management took over the birmingham last year, we've seen some incredible local bands through the venue and have grown to be a great fixture Melbourne's live music community.

The idea of hosting bands at the Birmingham is slowly fading due to noise complaints from one neighbour. And in the last couple of days,
has become serious to the point that we could be told to cease bands as of tonight - I would also like to point out that the neighbour moved into the residence after the venue had been hosting bands.

In a last minute dash - we are asking for anyone who has visited the venue, for a beer or a band, or even anyone who appreciates the importance of preserving the venue to sign this petition below.

Although - on a legal standpoint, the petition will not hold water, we are hoping to appeal to the neighbour so they can see the venue is loved and cherished by a broader public.

So, if you could please take the time to write a small message, or even just a signature - we will be passing this on the neighbour.

i signed it, but then it asked me to donate $ so i closed it, but i think my signation was registered. i'm pretty sure you can claim land rights against this person if you were there first and operating bands. xx

I used to live in Richmond near the MCG, and every weekend we would be over-run by drunken football and cricket fans.

Would they EVER consider banning the sport because of noise? NO.

I got woken up at 7am every morning of my holidays because they are demolishing and re-building the units next door to me (and my neighbour works night shifts!!) - do they tell the developers they can't build? NO.

People who live near rail crossings have to put up with the bells constantly- will they stop them ringing?
NO.
So why the fuck is a pub with live music told to stop trading as such???

Lots of people live, work and move around in or near the city. If you don't want other people's activites impacting on you life to some degree, MOVE THE FUCK OUT.

post as displayed on the Birmingham Hotel website.

The managers and owners are currently working with local
authorities and residents to ensure the Birmingham Hotel is
not in breach of the following license condition:

AMENITY

Thelicensee shall not cause or permit undue detriment to the
amenity of the area to arise out of or in connection with the use of

thepremises to which the licence relates during or immediately
after the trading hours authorised under this licence.

The licensee shall ensure that the level of noise emitted from the
licensed premises shall not exceed the permissible noise levels for

entertainmentnoise as specified in the State Environment
Protection Policy (Control of Music Noise from Public Premises) No.N-2.

At no stage has the future of live music within the Birmingham Hotel
been threatened, providing compliance with the above license condition is met.

The managers and owners of the Birmingham Hotel look forward to
many years of harmoniously existing with local residents and the
music community in this vibrant city of ours.

This reminds me of a guy I saw on Today Tonight or A Current Affair (I know) who complains about absolutely everything and makes like 100 complaint calls a day. I just don't understand a lot of people. Also reminds me of a bitch lady in my street who complained about lots of people parking in our street due to being near a train station and something about her mother and voila, changes the parking in the street to residents only. I hate these people!!!!!

That's all fine Cameron but you know as well as I do that the 70db limit or whatever it is that policy set by the council is impossible to meet when hosting full bands. Ask the NSC how much they spent on soundproofing. It's not a realistic noise limit and it's also unfair. But anyhow, good luck with it all, I'm sure something will be sorted.

Argh. Actually, a friend of mine had an upstairs neighbour who used to tell them off every evening for walking too loudly and talking to each other. Like, at 6pm. It just bothered him.
When they moved out to get away from him and a couple with a newborn moved in, he was down there every evening asking them to make the baby stop crying.

Anyway, topic.

I was wondering last night what the cause of the complaint really is. Is the person unhappy? Insomniac? Stressed? And they blame the noise because it's an obvious thing to take their frutration out on. But does the stopping of the live music actually solve their problem?

I am betting no one ever follows up on that sort of stuff.

The problem for whingers are the revelers walking past talking, pissing, spewing, fighting, etc. This usually happens on a Friday and Saturday night no matter in which suburb you live, but moreso obviously in established entertainment precincts.

People have parties in every suburb and walk home/to a main road to hail a cab. They often aren't quiet in doing so.

But some residents in Fitzroy, Collingwood etc assume everyone doing this ''must be leaving after seeing a band in that pub down the road''.

mushymouth that sounds like my old house. was it in abbotsford? that guy was a cunt, and apparently had problems with other people in the very small court, not just us who lived in the apartment below him. he once used his own keys in our lock to get in while we were there (who knows what he did when we were not) and stuck his foot in the door to force entry. anyway, back to the topic on hand. some people don't deserve the right to live in such a culturally diverse city.

But seriously, it wasn't people from the pub across the road. Why would they exit the pub, where there are toilets, to piss on my door? It was just an entertainment precinct, it was to be expected.
